How to Get Your Security Deposit Back in Austin

Under Texas Property Code §92.103, your landlord has 30 days after move-out to return your security deposit or send an itemized deduction list. Cleaning is the most common deduction. Here's how to avoid it.

The deposit-back checklist

In order of what landlords check first.

  • Inside the oven and stovetop drip pans
  • Bathrooms scrubbed (grout included)
  • Inside all cabinets and closets wiped
  • Fridge cleaned, defrosted if a freezer chest
  • All floors mopped, carpets vacuumed
  • Wall marks spot-cleaned
  • All light bulbs working

Timestamped photos of every room, every appliance interior, and every wall. Store in a dated folder — this is your evidence if you dispute a deduction.

Request a walk-through

Texas doesn't require landlords to walk through with you, but most will if you ask in writing. Bring your checklist and photos. Get any 'looks good' comments in a follow-up text.

If your deposit isn't returned

After 30 days, you can send a demand letter. If the landlord acted in bad faith, Texas law allows recovery of 3× the deposit plus $100 plus attorney's fees.
